Appointed share…The speech of Muqtada Al-Sayyid Muhammad Al-Sadr in his account in Twitter on 23/3/2021 In the name of Allah Appointed share Allah said in Holy Quran: (And do not long for things by which Allah has given superiority to some of you over others; for men is the share of what they earn; and for women the share from what they earn; and seek from Allah His munificence; indeed Allah knows everything). Nowadays the dispute intensifies in the case of equality between man and woman, the woman wishes the share of man, she doesn't satisfy that man's share is equal to that of two women, her witness should be like the witness of one man, or the guardianship or other matters, also the man wishes the share of woman from exempting him from Al-Jihad and expense and others, hence, Allah Glory to Him forbade that the first party longs for things of the second party, therefore we should illustrate some important matters to remove the suspicions which was and still reason of woman excessive liberality, and her anger on these rules from one side and intensifying the violence of men and their control from another side, in the beginning, we should separate and differentiate between two matters The first matter: The men and women in general not from being a husband and wife or from one family The second matter: Being the man a husband and the woman a wife and within one family as the brother and the sister whose share in the heritage is less than her brother share We should know that Al-Islam adopts the bestowal according to the justice not equality because some equality is injustice, hence Al-Islam obligated on man many matters which exempted woman from them and the more important matters are Al-Jihad, judiciary and expense. Also He gave man a genetic matters which He didn't give them to the woman whereas the man's water is more important than woman's womb especially with the development of science which it could find external incubator but it couldn't find substitute to man's water As to the woman, he gave her affection, beauty, procreation and motherhood and exempted from her Al-Jihad, judiciary and expense The Islamic base is: anyone whose duties increased, his bestowal increased and vise versa it means: the one whose duties decreased, his bestowal decreased, all these concerning male and female in general, but if we want to speak about the family and matrimonial and the guardianship of man on woman in it as in the speech of Allah: (Men are in charge of women, as Allah made one of them superior to the other, and because men spend their wealth for the women; so virtuous women are the reverent ones, guarding behind their husbands the way Allah has decreed guarding) I answer in more than one answer The first answer: The guardianship is limited if the dispute intensified between husband and wife only, in this case, the guardianship and final decision are to the man in order to end the dispute and if the decision of man is to depend on his wife opinion then it is within the guardianship and doesn't contradict with it The second answer: The guardianship isn't gain and feat to the man nor loss or defect to the woman absolutely but maybe it is the contrary to that The matter is: the bodily genesis of the man and his body power, his ability, his memory and mind are reason in giving him these duties which the man may escape from it for its difficulty and being a heavy responsibility, and the evidence on being guardianship is not feat to the man nor defect to the woman is the speech of Allah: (As Allah has made one of them superior to the other), it means there is preference to the man over the woman in some sides and preference to the woman over the man from other sides, whereas the honorable verse didn't say (the men are in charge of women as Allah preferred men on the women but as Allah has made one of them superior to the other. The general or private preference which we referred to it was legislated because the duties of man are more than the duties of woman, according to my understanding the preference which was mentioned in the two verses mentioned above is the preference in duties and rights not in the material and genetic matters whereas both of them are Allah creation and there is no difference between them other than these sides, therefore, the believer woman is better than the unbeliever man also they are equal in Paradise, Fire, sustenance, Divine mercy and the like. For approximation I say: they are equal in citizenship but they differ in duties and rights, each citizen has rights equally just if his bestowal increased then his fee increased too Also in Al-Islam: man and woman are equal in being Muslim but because they are different in duties and rights so their worldly bestowal and fees are different only not the hereafter one. It can't be said that giving the right of divorce to the man is preference on the woman, it can be answered As to the first: the divorce is hateful and destroying to the family, it is entanglement to the man As to the second: the emotion of woman is more than man, the possibility of divorce will be more and that is what Al-Islam doesn't want it As to the third: Al-Islam had legislated the divorce in consideration law from side of woman but even some of them gave fatwa to give the authority of divorce to the woman So even in the divorce there is no preference to the man over the woman Concerning the matter of witness and the man witness is equal to two women witnesses or the woman is half of man in witness, I say: there are many answers to that First: The witness is responsibility and exemption the woman from it is mercy not humiliation or belittling her Second: Al-Islam didn't want to exempt the witness of woman, maybe it will be reason to criticize her therefore it resorted to a middle solution Third: Apparently the memory of man is stronger than woman as it is said, therefore Allah said: (And appoint two witnesses from your men; then if two men are not available, one man and two women from those you would prefer to be witnesses, so if one of them forgets, the other can remind her..). There is a frank remembrance in the verse that the first woman should remind the second one for what we have mentioned that woman memory may be weak more than man then the right between the opponents may be lost especially in financial disputations, hence I can say that Al-Islam adopts that all are equal in creation but they differ in duties and rights and that is the justice itself, there is no injustice in it, but the injustice is: there is equality in rights with those whose duties and bestowals are not equal, if Al-Islam imposed expense on the woman then it will give her as the share of two man.Also the suspicion of oppressing the woman is refuted and can answer the west and positive laws and in the social matters, did you see a Western state ruled by women or most of the government are women? Al-Islam adopts the speech: the people who are ruled by woman will fail - there is no evidence on that- it is supposed that the West doesn't adopt that, so why we didn't find complete womanly government or employees (women) in places which need hard efforts or there is severe danger in it?We can satisfy in this speech in order not to expatiate in it.Allah is the source of each success Al-Sayyid Muqtada Al-Sadr
