The polygamy in Islam….The speech of Iraqi leader Al-Sayyid Muqtada Al-Sadr in his account in Twitter on 16/3/2023 In the name of Allah The polygamy in Islam I can present an idea in understanding this Islamic law to illustrate if it is permissible or not whereas it was said that the polygamy law have been changed through Allah speech: You will not be able to treat women with equal fairness, no matter how much you desire it And it was said that it haven’t been changed and they concluded that from the same verse (But do not be so biased) it means the complete justice will not be fulfilled but some of it may be fulfilled through never leave the another suspended and that is enough in their opinion; but I try to understand the Quranic verses concerning the polygamy in another way even if it is as an idea or possibility; hence I try to divide polygamy into two levels The first level: If the man wants to marry from more than one woman The second level: if the man married from more than one woman whether he is certain that he will be able to treat women with equal fairness but he couldn’t or he married more than one woman due to his ignorance or he doesn’t treat them with equal fairness intentionally, whereas the honorable verse: If you fear cannot act fairly towards the orphans then marry the women you like – two or three or four – but if you fear you will not be fair, then one, or what you already have; that makes it more likely that you avoid bias Indicates to the first level, it means he intends to marry more than one woman and its law is: the polygamy is not permissible just with certainty of be fair with them otherwise he marries only one woman Yes, the required is the certainty because the verse said: but if you fear, you will not be fair, it means there is no certainty but it is doubt of never be fair between them; it means the doubt of never be fair between them requires to marry one woman only The honorable verse: You will not be able to treat women with equal fairness, no matter how much you desire it. But do not be so biased as to leave another suspended. If you make amends, and act righteously, Allah is Forgiving and Merciful Which indicates to inability of treat women with equal fairness no matter how much he desires it, also it indicates to be satisfied with some fairness as to never leave another suspended in which he doesn’t treat her as a husband nor he divorces her to marry another man so this verse indicates to the second level; it means the one who married more than one woman so let him fear Allah and never oppress any one from his wives and leaves her suspended The legislator doesn’t order the husband to divorce them or one of them because it is ugly matter and it may oppress the wife in large and clear way, there is no doubt that never be fair with them will make the husband sinner therefore Allah commanded him in the same verse to amend and act righteously and never be so biased and to return to basic laws in the marriage relation as divorce or divorce the woman with waiving of her rights in the case of despair of reconciliation as it is known at the jurists; but here I don’t want and cannot give fatwa of forbiddance of the first level and invalidity of marriage contract because it needs to fatwa from religious jurist who reached to degree of giving such fatwa of being valid or not Muqtada Al-Sadr
